At Alekman DiTusa LLC, we believe that every child deserves a safe environment to learn and grow. Our firm achieved a historic legal victory in Western Massachusetts, securing settlements of $13 million and $1.8 million on behalf of two survivors of child abuse in a widely publicized local case.
Paid by the City of Springfield, these settlements provide a crucial measure of financial security for the survivors and their families while serving as a beacon of hope for others who have suffered from personal injury or sexual assault.
The Background: Systemic Negligence and Ignored Red Flags
Two federal civil lawsuits were filed against former Springfield STEM Middle Academy teacher Robert Gayle, alleging that he sexually harassed, groomed, and abused middle school students under his supervision.
However, the abuse did not happen in a vacuum. The lawsuit also named the City of Springfield and school administrators—including former principal Luis Martinez—for categorically failing to act on repeated warnings from parents and staff regarding Gayle’s inappropriate behavior.
Administrators were alerted to multiple "red flags" concerning Gayle's conduct, including:
-
Driving female students home from practice.
-
Showing blatant favoritism toward female students over male students.
-
Providing students with passes to get out of trouble.
-
Gifting food and presents to specific students.
Despite these clear warning signs—and direct reports from parents, including one who voiced concern over Gayle allegedly asking their child to stay after school alone—the administration dismissed the concerns. This lack of intervention allowed the misconduct to escalate unchecked, ultimately resulting in multiple criminal charges and profound harm to the students.
The Fight for Accountability
Attorneys Laura Mangini and Robert DiTusa, partners at Alekman DiTusa LLC, alongside Alexander Snierson of the Sneirson Law Firm, took on the case to advocate for the vulnerable. The legal team's goal was not just to address the actions of the individual abuser but to shine a spotlight on how institutional failures directly contributed to the harm suffered by these children.
"Every child who goes to school should be safe. There is no question the City, and its school administrators, categorically failed in their responsibility to protect children in their care. Moreover, the civil justice system is the only place where survivors can demand accountability from both perpetrators and institutions. We are privileged to have had the opportunity to walk alongside these two families and achieve lasting change."

The Resolution: A Step Toward Healing and Prevention
Following voluntary mediation in Federal Court in Boston in November 2025, the parties reached historic settlements totaling $14.8 million.
This result sends a resounding message to our community: institutional negligence, alongside individual predatory and grooming behavior, will not be tolerated.
"While no amount of money can truly undo the harm that was inflicted, this settlement provides financial security and validation that the families’ voices were heard and their pain was real. The settlements are a crucial step toward healing, prevention, and systemic change. These cases underscore our firm's unwavering commitment to advocating for the most vulnerable among us."
